The manager will identify opportunities to reduce privacy and risk management risks, initiate, facilitate, and promote activities to foster a culture of privacy compliance.

Essential Job Duties and Responsibilities –

  • Identify opportunities to reduce privacy and risk management risks
  • Initiate, facilitate, and promote activities to foster a culture of privacy compliance
  • Investigate, document, and determine the probability of compromise for privacy investigations/grievances received via patient and staff complaints, EHR audit trail monitoring program, corporate compliance hotline, incident reporting, Data Integrity reported events, patient portal reported events, and others as reported
  • Complete privacy risk assessment, create patient notification correspondence, and document corrective action plans for confirmed privacy incidents.
  • Manage reporting of confirmed privacy breaches to the Office for Civil Rights annually
  • Develop and oversee privacy sanctions log
  • Manage, and investigate, results of Bluesight audit trail privacy monitoring program, coordinating with RWJBarnabas Health Legal Affairs, Operations, and Human Resources, as needed.
  • Liaison with applicable third-party Business Associates regarding privacy matters and investigations. Facilitate patient requests to opt-out of the Health Information Exchange and/or Research Partners
  • Consult with Health Information Management (HIM) and Release of Information vendor and, as applicable, the clinical team, in responding to requests to access medical information and address compliance with Information Blocking requirements.
  • Consult with HIM and Operations in their process for responding to requests for accounting of disclosures, and coordinate with departments across the designated sites to ensure that all applicable departments are tracking those disclosures that must be tracked.
  • Act as a liaison with other system risk managers and privacy managers/officers and participate in system-level privacy and risk meetings.
  • Attend department and leadership meetings as needed as a representative for Privacy and Risk Management
  • Create periodic summaries of privacy–related compliance and investigative activities, and if requested, report those summaries to various affiliate and system-wide committees and officials. Facilitate effective communication regarding privacy initiatives
  • Provide Risk Management and Privacy educational training to Hospital staff/employed/ independent practitioners as part of the Hospitals' orientation process and ongoing education deemed appropriate for risk management and privacy.
  • Administration of tracking documentation addressing (i) subpoenas, (ii) medical malpractice and other litigation claims and (iii) lost and personal belongings, including reimbursement for such items.
  • Reviews Summons & Complaints for coverage related issues and ensures notification to appropriate carriers.
  • Work to resolve patient and family grievances against the hospital by listening and communicating with the parties, in order to avoid escalation of grievances into genuine claims
  • Respond to and investigate inquiries from Federal and State governmental agencies
  • Coach employees in collaboration with the Leadership team, Human Resources and AVP Risk and Privacy, as needed for privacy breeches.
  • In collaboration with Quality, Leadership Team and AVP Risk and Privacy, assist in Root Cause Analysis/Apparent Cause Analysis process, including the reporting of events to Regulatory Agencies.
  • Analyzes safety events for trends, high risk exposure, potentially compensable events, patient/staff issues
  • Compiles data for Hospital Professional Liability and General Liability annual renewal application
  • Coordinates patient and staff reimbursement for lost or damaged personal property
  • Assist in coordinating with the hospital and corporate legal the investigation and follow up with guardianship matters.
  • Coordinates distribution of product recalls and product updates received directly from the manufacturer or product distributor.
  • Coordinates reimbursement for auto damage claims and asset retirement
  • Coordinates with defense attorneys (outside counsel) to arrange for depositions or questioning
  • Coordinates procurement of responses to Discovery propounded by hospital and staff
  • Interface with legal counsel, including outside counsel at all phases of discovery, litigation and trial preparation.
  • Investigates all hospital related risks involving actual injury to patients, visitors, employees and property
  • Formulates and reviews policies to protect patients, visitors, staff and hospital
  • Develop and compiles question-specific incident report-based reports
  • Maintains active, closed and claims made litigation files
  • Monitors alert tracker recall system responses to ensure timely and complete data entry into recall data base
  • Reviews incident event reports and collaborates with the management team to ensure patient safety and close out event
  • Submits Medwatch reports to FDA regarding defective medical devices
  • Effectively supports the Performance Improvement and Patient Safety Committee
  • Facilitates Serious Safety Event Classification meetings
  • Completes Board of Trustee reports and submits to Chief Administrative Officer
