Partner / Of Counsel Bankruptcy, Financial Reorganization & Creditors' Rights
Position OverviewWe are seeking an experienced senior bankruptcy and restructuring attorney to join our firm as Partner or Of Counsel in the Bankruptcy, Financial Reorganization & Creditors' Rights practice. The successful candidate will lead complex Chapter 11 restructurings, represent secured and unsecured creditors, debtors, and stakeholders in contested matters and adversary proceedings, and develop business within and beyond our regional footprint. This role requires deep substantive knowledge of insolvency law, proven courtroom and transactional experience, and an ability to supervise teams and deliver strategic, commercially-minded advice to sophisticated clients. Key Responsibilities
- Lead and manage Chapter 11 cases, including representation of debtors, creditor constituencies, official and ad hoc committees, trustees, and creditors in contested matters and plan negotiations.
- Advise clients on cash collateral contests, debtor-in-possession (DIP) financing, and the negotiation and documentation of post-petition financing facilities.
- Handle fraudulent transfer, preference, and other avoidance action litigation from investigation through trial and appeal.
- Develop and execute financial restructuring strategies, including out-of-court workouts, debt-for-equity swaps, distressed M&A, and cross-border insolvency coordination where applicable.
- Counsel clients on creditors rights enforcement, loan workouts, foreclosure remedies, and enforcement of security interests.
- Draft and argue motions, disclosure statements, plan confirmation pleadings, and other complex bankruptcy filings; lead hearings in federal bankruptcy courts (including NJ and NY where applicable).
- Supervise, mentor, and delegate work to associates and paralegals; manage case staffing, budgets, and client billing expectations.
- Drive business development through client relationship management, pitch work, thought leadership, and participation in industry and bar events.
- Collaborate with transactional, tax, litigation, and regulatory teams to provide integrated advice on restructuring, insolvency, and distressed transactions.
Qualifications
- J.D. from an accredited law school and admission to the New Jersey Bar; New York Bar a plus (admission to both preferred).
- 8+ years of substantial bankruptcy, restructuring, and creditors rights experience, including a track record in Chapter 11 reorganization matters.
- Demonstrated experience handling cash collateral disputes, DIP financing, and restructuring financing transactions.
- Proven litigation experience in adversary proceedings, fraudulent transfer and preference actions, and contested confirmation hearings.
- Strong transactional skills in restructurings: workouts, distressed M&A, debt restructurings, and negotiated out-of-court solutions.
- Ability to lead client engagements, build business, and maintain strong client relationships; prior partnership-level or of-counsel experience preferred.
- Excellent drafting, oral advocacy, and courtroom presence; comfortable leading hearings in bankruptcy courts (NJ and NY experience preferred).
- Experience supervising and mentoring junior attorneys and managing teams on complex, high-value matters.
- Commercial acumen, problem-solving orientation, and the ability to translate legal strategy into practical business solutions for creditors, debtors, and other stakeholders.
- Willingness to travel as required and to participate actively in industry associations and thought leadership (publications, presentations).
